Zoning Board of Appeals

The Zoning Board of Appeals is a body that has the authority to vary zoning regulations in keeping with their general purpose and intent, to determine that decisions of the Zoning Enforcement Officer were made erroneously, and to hear and decide all matters pertaining to special exemptions and special exceptions to the zoning regulations. Applicants or affected parties who think that decisions were made in error, and property owners who think that the regulations impose an undue hardship on the development of their property can appeal to the ZBA. If they do not accept the ZBA’s decision, they can take the matter to Superior Court. There are time limits between when a decision is made and an appeal must be filed. The ZBA does not meet regularly. It will meet when an appeal is filed, and notices about the meeting will be posted.
